Deseased Father's home--need legal advice by jessica widener on December 29, 2001 @14:26

My father died, and some people moved into his house without us knowing. They contacted us when only when the police told them they had to. My sister sent them a typed paper giving them permission to buy the house. My signature was not on that paper nor was anything legalize. I do not wish to sell the house, but am willing to rent it to these people. The problem is that they say that they have put six thousands dollars into the house when they thought they were going to buy it. They have been living there for six months that we know of without ever paying anything in rent. How do I go about leasing it to them? HELP!!!!

HELP!!!! >> >> >> Dear Jessica, You have squatters in your house who were never qualified to rent from you in the first place. I know about this because it happened to me too. Please do not deal with these people. If you really want to rent to these people, this is what you should do: 1. Get a rental application filled out by them. 2. Check out the Application thoroughly. Find out if these are the kind of people qualified to rent from you. (Anyone who illegally moves into a home has got to be bad news!) 3. If they don't check out well, don't walk, RUN to a good eviction attorney and start the eviction process immediately. Your sister may have made tenants out of trespassers by trying to make a deal with them. That was the mistake I made. They should have been taken out by the police right away. Do not be fooled into thinking you can make a good situation out of this tenancy. Do not feel obligated because these squatters say they invested money in the property. You did not give them permission to work on your house. You need tenants that You pick and are qualified and agree to your lease. (Make sure it's a landlord lease) Good luck with this. Let us know what happens. Jack
