I would have taken them before the magistrate already, and had the county sheriffs out to evict them to the street.
this is why i use a 10 day eviction from the very 1st lease violation.

>>I have had trouble with my renters from day one. They have only been there since January, but they have never paid rent on time. They have written me a bad check which took them a month to cover, have made partial rent payments, or just not paid at all. I have had to make several trips each month to the house to collect rent only to hear another excuse for not having it. A neighbor has also complained of the couple yelling and fighting in the yard. They also have not kept the yard mowed. I gave them a 30-day notice last month when I collected rent. When the 30 days were up I went to see if they were moving and they informed me that no they weren't moving and that I would have to take them to court to get them out. They want their deposit back (which I only required $100) and they want me to reimburse them for painting four rooms. When I first showed them the house, I told them I was not painting, it was not in need. They asked if they could do it themselves and I told them they could but I would not cover it and I wanted to know exactlty what they were painting. They also told me I could not evict them and then collect rent. My question is, do I have the right to collect the rent when I gave them a 30-day eviction? If they had moved out before the 30 days, they would have been reimbured for the remainder of the month. This is the first time I have rented a house, and it has been a nightmare. Any advice you could give me would be appreciated.
