I was partly lucky these people moved out last June 15, 2002 on request.I could not do anything through court because the cost of this process was very expensive due to the fact they were living in the basement and it was illegal. They left with a debt of $1700.00 and after having reported the apartment as illegal to Housing Department. Now I have to deal with the expenses of the legal process. I do not have a judgement against them and I do not want to start one now. I just want to ruin their credit and advise other landlords about these bad tenants. Please I will wait for an advise. I live in Queens, New York, Thank you

Last night they told me that they are looking for a place to move and they will need more time. We both agreed they could stay until the end of this month and if they needed more time they will let me know. They already used their security month in April and now they said that they may not pay anymore rent because the real state is charging them one month rent beside one security month and one rent for the new apartment. I already told them that if they live in the apartment they will have to pay rent until they vacate it because I'm still paying utilities and mortgage. What should I do next? Wait a couple of days or take immediate legal actions? I live in New York Thank you

>>Dear Nelly,
>>
>>It seems like the tenants think they've got you where they want you, since they think you have no more leverage on them without the security deposit.
>>
>>But that's not true.
>>
>>You have the ability to damage their credit, get a judgement for the 2 months rent. (The security was "used" in good faith, but now if they are defaulting, it means they just didn't pay April's or MAy's rent)
>>
>>If they ever want to qualify for a mortgage , credit card, car loan, etc., they will have to pay the rent.
>>
>>You also can give a good or bad reference.
>>
>>Also, if you join The LPA, you can report them on the NTRB (Deadbeat Database) where all landlords can check them out.
>>
>>
>>
>>I'd suggest an "Urgent Late Notice- Eviction Status Warning" form.
>>
>>Don't worry if the apartment is an "illegal rental". The court does not care. It is only a zoning matter.
>>
>>Good luck.
