Your security deposit was applied to the months rent with or without the 30 day notice. Why should we take a deposit in the first place if tenants can back out and expect it back? That would be defeating the whole purpose of taking the money in the first place. Why do you think you paid the deposit? It doesn't matter if that landlord has 50 or 5000 other apartments, the fact is he/she held this place for you. Tenants should just expect to lose the money if THEY change their minds. Just like the other poster said, how would you like it if the landlord rented that place out from under you when you were ready to move in? It's the same principle, in the future, don't give a deposit unless you are sure that you will not back out. After all, that is what you are saying when you give money to hold the place, why would you expect to sign something to indicate that?

Well usually when you put down a security deposit you sign a lease, so the LL will have IN WRITING that i said that i was going to live there and that i knew i was going to forfeit my security deposit if i changed my mind. Yet, i didn't sign a thing, she has so proof, so if i do take this to court (and you seem like a LL so..) what would you say in court? because you have to have a legal document that states that i knew i would lose the deposit...so if you didn't have to sign anything what would your defense be? And believe me i have been to court and there is not just thing as a verbal agreement so therefore you need evidence that i signed.
