You left a deposit on an apartment. That alone proves that you were going to rent that apartment. No one goes around leaving deposits on apartments they don't intend to rent. The fact that the LL accepted your deposit proves she was willing to accept you as a tenant and rent the unit to you. Thus it was a verbal agreement to rent the unit. Now that you want to back out, you want to break the verbal agreement. Without a written term lease, the state makes an agreement for you and declares that you have a month to month agreement. So youhave to give 30 days notice to back out. You owe for that 30 days. Very simple to prove in court.
