How long ago did you give the deposit? How long after that did you inform the landlord of your change of mind? Have you avoided or held out for more time to fill out application and/or lease? If so, that may cause you a bit of problem. Otherwise, if it is as you say, you have a receipt, did not fill out an application nor a lease and you havn't extended time to act or ignore the landlord when it was time to do paperwork. You might have something to take to court. Have you notified the landlord of your change of mind? And have you requested the deposit back? These questions are'nt meant to be answered, just for you to take into consideration to better determine if you should file a small claims. Be sure to request the money back first.
