Hey guys,

I am looking for a clear definition to wear and tear for the state of Pennsylvania that would be able to hold up in court. I looked everywhere, but it seems that I find lists that are the opinion of others. I even checked this website and found nothing official. The PA Landlord and Tenant act doesn't contain it eithe.r Any help offered will be greatly appreciated.

Sorry you will not be able to find an exact definition. Wear & Tear is open to interpretation of the individual situation in PA and everywhere else.

If you consider wear & tear unreasonably bad for the length of time the tenants used something, you may be able to collect something for it.
Your chances of no argument are best if it is no-brainer - like totally obvious that the item was abused.

No one has a definitive definition of W&T. The best one I ever saw was that "Wear & Tear is the expected, normal deterioration of objects based on the length of the tenancy and the authorized occupants and pets using them in a careful, reasonable manner of use. It will vary based on the number of people and pets who live in a property and the length of time of the tenancy.

It does not include neglect or carelessness, nor use by unauthorized people or pets."

The apartment must be restored to the original or improved condition in order to receive a security deposit refund. The definition of “normal wear and tear” are unavoidable issues not caused by the tenant, such as faded paint, loose hinges, permitted items, etc. Expect deductions to repair holes in the wall if the lease stipulates no nails or holes allowed in walls. Any items that tenant has not maintained, cleaned, prevented or received permission to perform are classified as damages and can be deducted from the security.
