don't do anything until you have notified the tenant in WRITING of any lease violations. After your states notice to cure period, you might have the right to change locks and take back the property.
Use LPAs Lease violation notice.
Also a security settlement statement to account for your expenses and costs until you re-rent.

You may have to prove that the property has been shut down and abandoned.

I have a question not sure what anyone know about this situation. I have tenent that were served a eviction notice and is suppose to be out by Dec 1 08. They have not stayed at this apartment for over a week and I know for a fact they still have alot of stuff in the apartment still. On Dec 1, they have the 30 days notice, if they abandon the property what is my legal remedy for taking back my apartment so i can clean and rerent it. also, what can i do with the property that was left?
