my lanlord is trying to evict me .. i have a 15 yr old?? wants us out in 30 days. but im paid up on rent. he wants to remodel his house.

Your LL is not evicting you yet. A 30 day notice to move is asking you to move even though the rent is paid, should be paid because you are there. If you do not get out by the end of that 30 day notice, your LL can and wiil evict you. Does, not matter if you have kids, winter or bed bound, a LL can evict for non-payment or in your case holdover after the 30 days expire.

It does not matter why. You are on your way out. Look for a place now before you spend Christmas on the curb.

You are not being evicted. An eviction is a court order. What you have received is a 30 day notice to vacate based on the fact that you do not have a lease. Without a lease, either party can terminate the agreement by merely giving 30 days notice. This is state law. No reason is needed for this. The season of the year or who is in your family has no bearing on this notice. You have 30 days to move out. If you fail to, the LL can and will file for eviction in court. If this happens, you can be set out on the street by a sheriff after the court case is final. This would not be good during the holidays. Find a new place and move before the 30 days.

Did you pay your rent?? WHo cares if you have a 15 year old - PAY YOUR RENT and you wont have a problem.

Too many people try to hide behind children. Our laws are SOOOOO terrible.

That's the problem with renting -- the property belongs to your LL and he has every right to get it back in his possession with proper notice to the tenant. You received proper 30-day notice to vacate from your LL and now you need to move. The only way to avoid this is to buy your own property. Meanwhile, the age and number of your kids, illness of your dear old granny living with you, or any other situations you created are your own problems and will have no effect whatsoever on whether you can be evicted.
