HE SHOULD HAVE MONTH TO MONTH THEN. I HAVE A LEASE YR TO YR AND GOT THE NOTICE OCT 15TH.. MY LEASE IS NOT UP TILL AUG 1ST 2010.

If, in fact, you have an annual lease and is does not expires until 8/1/2010, he cannot make you leave on a 30-day notice, unless there is a lease-break clause contained in your lease. Read it to be sure. If no lease-break clause, he cannot remove you from the property except for a violation of the lease agreement, or for non-payment of rent. After you have reviewed your lease and are confident about it not having a lease-breaking clause, then you need to talk to your LL and explain that you cannot be removed except for lease violation or non-payment.

Then that is a different situation. If your rent is current and you have a lease that has not expired assuming there is not a lease break clause in it, then he can not make you move. Read your lease carefully to see if there is anything in it that gives the landlord the right to break the lease, which may or may not hold up in court if you dig your heals in and stay. If nothing in the lease allowing him to break the lease, then put in writting to the landlord that you are not moving and he can not break the lease.

I have a feeling that he wants you out for other reasons than to remodel.
