Sounds like the owner is putting you in the middle of something he should handle himself. You should tell the owner to handle this, since he/she knows what is really going on. If the guy has no business moving in, the owner can change the locks.

The owner has/had no idea what is going on he spoke to the officers I was speaking to about an hour ago and told them he does not want him in the apartment and that he was to be removed.... They did nothing:( I have lived in this town for a few months now after living in 2 other states and have found the police are the least helpful here than any other state i have visited or lived.

    Does the owner say that the guy paid any money for a deposit? If so, he needs to return it, collecting any money for a rental unit implies possession. This makes it a problem. He will have to evict the guy, or take his chances and change the locks and remove his belongings and store them until he retreives them.
