DO YOU WANT THEM OUT? YES OR NO?

If the answer is yes, you already have your grounds to evict and you cannot take ANY money.

I wish people who give advice on this board would at least be familiar with the laws.

    Accepting rent when you are evicting for violation OTHER than non-payment will not affect your outcome. In addition, you cannot sue for non-payment of rent until you have provided a P/Q notice per state law, and that hasn't happened. OP provided a C/Q notice for lease violations. If she wishes to evict for non-payment, she must being with the P/Q notice, unless she is in a state which doesn't require it.
