When you say the court won't enforce the judgment, do you mean you cannot garnish wages and bank accounts in FL? And that you can't ask for judgment to include continuing attorney fees?

Yes my understanding is the landlord cannot garnish wages or bank accounts in Florida. If that were the case I would bring the x-tenant to court. But without enforcement of the judgment my recourse would be a collection agency.

That makes no sense. Your recourse with a collection agency would follow after you win a judgment. Have you ever actually filed a suit for money owed against a tenant? If you have and you won a judgment and the court does not offer the garnishment or attatching a checking account, then turn the judgment over to a collection agency to collect for you. You could be wrong on the understanding that courts in Florida don't do garnishments, where did you get that information from?

I got the information from the Real Estate company that manages my rental properties. They tell me in most cases bringing the x-tenant to court will only result in a judgment in the landlords favor with no recourse to recover monetary damages. In other words in Florida you are wasting your time and money! If this is not correct please let me know and I will bring it up to my Rental Agent!

Check out this site: http://www.clerk.co.okeechobee.fl.us/PDF%20Files/How%20To%20Collect%20a%20Judgment%20In%20Florida.pdf It appears you can have a sheriff seize property owned by the ex-tenants once you get a judgment lien. You can take their car and other property and have it sold to pay you.
