Getting Renters out

Renter does not want to get out. They should have been out by Nov1.. They are dragging their feet. We had a 6 month lease with a stipulation that she should let me know if she wanted a new lease. This did not happen and she paid per month. Oct 1 she said she will move out by the end of the month. but she has not. What can I do?

If their lease has expired, you can simply give them a one month written notice to vacate. State that you are terminating their month to month tenancy and that they need to be out of the unit and return the keys by the end of that period. Keep a copy of the notice. If they do not move out, file to evict.

It doesn't sound like the tenant paid the rent for this months since they are "dragging their feet to get out. If that is the case, you need to serve them proper notice per your State. My guess is a pay/quit notice, you also need to find out per your State how many day notice you must give before you can file for eviction.

If she's not paying, post a pay or quit and evict. If she gave you written notice, file for eviction, if she gave you verbal notice, and you don't have proof give her a 30 day notice, and if she still doesn't move, follow through with eviction.
