Client has MTM Sect 8 tenant. Have given 90 day 'termination of tenancy notice' to sell house. Angry tenant says no showings, no for sale sign, etc. Housing authority refers to attorney for advice but client short funds to seek legal counsel. What are landlord's rights to try to sell house during next 90 days? Thanks so much!

Refer to your original lease for this tenant -- when the original lease expired and you switched to M2M, the terms of the original lease continue to be effective. So if the lease allows for showings after notice to vacate, then yes you can show. If tenant obstructs showing, you can evict for violation of the lease, after posting C/Q notice. If your original agreement is M2M rental agreement, then again you must refer to the language of the agreement to see if you have the right to show.

Have you read thoroughly the LL/T law for CA? That may also contain a solution for you.

Hopefully your lease covers this, and hopefully you didn't use the section 8 lease. Even if you did give 90 day notice, they may stay, which means an eviction anyway. You should be able to sell the house, even with an exisiting tenant, but not many people would want to buy a house with a section 8 tenant in it. You may have to remind them that it is your house and they are not the boss.
