XXX has given good advice - the presence of mice has NOTHING to do with not paying the rent. Get that notice from the exterminator that the problem has been solved, give a copy to the tenant with a note adding something to the effect that further infestation will be considered negligence on the tenants part and future treatment will be billed to them. You are well advised to do an inspection, if for nothing else, to "change the filters" - get in there, take a camera and take photos of what i suspect is sloppy housekeeping, thus laying out a buffet for vermin.

Yes. As I have taken immediate care to the violate notes by hiring all licensed professionals to check and document the damage, my case is clear to kick off the non-rent payment eviction. Estimate the tenants should be out before or right after Christmas or no later than the second weekend of Jan. 2010. Also, I live there for 10 years before renting it out. I have never seen a single mice. Then, I download the instructions of cleaning up the infested areas from the local state government site, and suggestions - how to prevent any pest infested from developing and growing. I state those are the tenants' responsibilities. More, I ask the neighbors to let me know immediately if the tenants bother them from all aspects. I will address it! I did take photos before and after the tenants taken the property.
