Thank you, I like this solution. It seems a little unfair to the new tenant that I have her money in the event she doesn't move in but she has no guarantee from me that she can move in. But I guess that's the way it has to be because of the situation my current tenant has brought upon us all!

That's the way it is regardless. Tenants have to give a "deposit" to secure their pledge to rent the place. Money shows they are a little more serious about it. So many of them would back out and change their minds if they didn't have money rideing on it. However, it's only fair that you do give the money back to that prospect if for any reason on your part that you do not rent to that tenant. You can't reject them and keep their money. Basically, it's whoever changes their mind loses that money, kinda like the money in escrow sort of speak until the final outcome. In the mean time of your situation. You have to get rid of the current tenant to make ready for the new one. That is the tenants fault that she is now in this situation. Problem is, if current tenant does not move out within the 30 day notice period, you will have to file to evict which will take longer to get your place back for the new tenant.

My tenants' current lease doesn't expire until January 15. So I should send the 30-day notice on December 15, right? I can't send it now because she is entitled to stay there until January 15th, of course as long as she is current on rent etc.

I would send her the notice to move as soon as you collect the holding fee from the applicant who applied for your place. This would give her plenty of time to move out. She has until Jan 15th like you said, when her lease expires.
