We always have them provide a doctor's verification that it indeed a "service animal" And I understand the need for groups to watch out for those that might be discriminated against. My error was not a blantant disregard of the regulations though, and I think there needs to be a better way of "educating" people than to have testers call landlords/property managers and find out what one does NOT know. and then serve them with an outrageous settlement fee.

I don't understand how they can fine you. Are they a government agency? If not then tell them to go to hell.

I would fight it. You didn't technically discriminate or say that they would have to pay a SD for a pet. You said "possible" pet deposit "may" apply, since you weren't sure and were going to check law prior to giving anything firm. Besides if the animal didn't actually check out to be a service animal, but a pet there would be a pet deposit.

They "settle" with you NOT fine you. They were a little vague who they were under but their agency = Intermountain Fair Housing Agency. IHFC. I am using this forum to find out if others know more about this agecny and have had any similar experiences. & also let other property manager/landlords KNOW that this can happen to them. One has to be very careful what they ask or say to potential tenants. These testers do call randomly and it is costly. No slap on the wrist for the first offense, they will settle and it could be HUGE $$$.
