Smoking Allowed? by Brandon (OK) on November 19, 2009 @23:34
I'm in the Oklahoma and I had an owner ask if it's legal to prohibit the tenants from smoking in the house.

I know state govt's have made an effort on banning smoking in public places but I do not believe that you can explicitly prohibit smoking inside the house.

Can someone clear the air for me? (No pun intended)

The owner of the property can say what they allow and do not allow, smoking being included.

Is it illegal to tell someone not to smoke in your car just because it is not a public place. You own the car, you make the rules.

Agreed. The owner can prohibit smoking in any rental, as well as any pets, extended visitors (reasonable visits are permitted), home businesses, and so on. The owner only needs to either place this in the lease before signing, or to give a month to month tenant an official written notice of the rules change (giving him the sufficient time required by your state laws.)

Absolutely! I do not permit smoking in my rentals. It damages the paintwork and can be a fire hazard.
