Only if the word recidivism means nothing to you. Those convicted of crimes are not a protected class and can be disqualified. It is not illegal unless the person is denied for one of the illegal reasons. The protected classes are race, color, sex, handicap, familial status, or national origin. (Those would all be illegal reasons to deny, and are thus discrimination.) No other class is protected.
