my Uncle moved a renter into my moms residence while she was away on vacation to florida along with all of her personal belongings. This house is one of three houses on my Grandfathers property and is not in her name. THe renter has no lease and refuses to give my mother back any of her personal belongings. the renter pays in cash weekly and has provided no mailing address, since they are in a remote location that does not receive mail. Now after several moths the renter has broken her leg, and now states that she cannot pay intil she receives emergency funds due to her law suit with a large department store. Where do we begin to correct this problem? we would like to have her evicted, and the back rent paid. Should we serve her with a lease agreement, or a demand for posession? please advise

Neither you nor your mother can evict this person since neither of you own the property. Neither can your uncle, same reason. If your granfather is still alive, he will have to evict the tenant. If he is not, his estate will have to enter probate, an executor or personal rep must be established by court order and that person can then evict this tenant. What a can of worms!

If the tenant is disabled due to her accident look for greater difficulty with the eviction. She will also get help from the lawyer who is handling her settlement. There are a couple of question that need answering. Who actually owns the property? And, if the ownership does not belong to your Uncle, did he have the authority to contract with the tenant?
