Month To Month Lease Extension Fee?

My tenants are completing a 12 month lease with me (LPA lease used) and have requested a one month extension. They are actually paid through month 13 already. They have been good tenants and I have no problem granting a one month extension based on their record with me. However, this additional month is delaying my renting the house to new tenants or selling it. I am going to request a month-to-month extension fee of $450.00 to cover this delay. Do you see any problem in requiring this fee? I am not raising the rent or requiring additional security deposit. They did not give me notice within the required 30 days per LPA lease. Texas.

You can charge the fee, but you'd have to give written notice of the fee as per the lease notice periods (30 days). I don't know how well they'll go along with it, but they are causing a hardship on you with the extension.

They have already paid through the extra month and you have accepted it and allowed them to stay one additional month. You can't try now after the fact to get more money out of them. If you wanted to do that for going month to month, then as said above, you need to give them 30 day notice prior to charging it. IF you want you can go ahead and do that so that if they stay beyond this one month they pay. Now since you didn't decide this and get it before accepting the additional rent you are out of luck. Also, they are delaying you re-renting the place, but you are getting paid for the dalay, you are getting the regular rent. In my state if I don't allow them to stay beyond the lease they pay 2x monthly rent as holdover. Otherwise I would just get regular amount of rent.
