Tenant Utility Co. asks LL for access

I found out a few days ago that when this tenant moved in she used someone's name for both gas and electric. I supply oil heat. I know it is legal for some to do a name other than your own for utilities but she has not made the Utility Co. since she moved in Jan. 2008. The Utility Co. asked me for acces to shut off the gas on Tues. this coming week. What should I do? I have had problems with this tenant as well.

I would tell the utility company to gain access through the tenant and to leave you out of it. But then I would also send a lease violation notice to the tenant to cure the default. I don't know if the law would be on your side if you gave the utility company access to your tenants home.

Wouldn't it be simpler to tell the tenant to pay the bill or the utility company will force you to allow access to cut the power off. Then the tenant can decide if he wants to pay or get cut off.

The utility company asked you to access the meters and valves. A reasonable request. For all you know, they just want to check for leaks. They can't prove that you knew the company was going to shut off service. This was the utility's doing, not yours. You simply allowed them access to their equipment.
