We lease lake lots only; tenants put pre-fabs, trailers on them. Our lease specifies that the septic tank and field lines are tenant's responsiblities (now thanks to LPA we have a sewage agreement!). A tenant who leased from us for 23 years died; she had her own septic tank and practically poured grease in it. In the last year she had it pumped out twice (but did not remove grease from outlet and field lines). Her granddaughter inherits the trailer; when we told her she also inherited the responsiblities in the lease she said she was going to sell the trailer to move off of the lot so she wouldn't have to fix the septic tank.Any ideas? Would especially like to hear from LL's who lease lots to people who own the mobile homes. Thanks!

What specifically are you asking help with?

Do you wish to bring the 23 year old septic tank & lines up to code and make tenant pay for it?

Do you want to fill it in, build a new one and charge tenant for it?

Do you get SD's from trailer tenants or would you have to sue?

I would check into the laws that allow you to place a lien on the trailer and prohibit its move or sale prior to reparations required. However, as you had no agreement with old lady, and the tank was "hers," unless there are local ordinances obliging trailer lot renters to maintain septics to a certain standard, you may be SOL and the best bet is to just fill it in and dig a new one.

Just the cost of doing business for 23 years.
