Experience with Homeowners Associations? by Anonymous on March 14, 2010 @15:36
Does anybody have experience or advice in fighting homeowners associations? I have a rental SFH in a nice development governed by a HA. In general, the rules & regs aren't too bad, but the majority of the owners are older retired folks with nothing to do except one-up each other as to maintenance, painting and landscaping. For example, if one repaints their shutters, they now believe that everyone else needs to paint their shutters as well, because this "keeps the values high" even though there is nothing wrong with the other houses' paint except for a little normal fading. But the notices start going out with "helpful" suggestions that everybody should repaint, and remainders that the HA R&R states that painting "should" be done every few years and veiled threats that the HA has authority to do it for you and bill you for it.

So far no overt actions yet, but with the spring coming up, I'd like to be prepared.

Any advice out there?

The only thing you should do now is do nothing.

Fighting the HA? You are going to find it easier to paint and maintain your property to the community standard.

It's easier to just stay away from property with a HA. It's bad enough I have to fight the town over codes that were written 50+ years ago, but I don't need someone else telling me how to maintain my property at my cost.
