our rights by munchkin (tennessee) on March 19, 2010 @17:51
our electric bill for dec., Jan., and Feb. was $900. We told the landlord and he said everyone's was due to the cold. we told him that the unit had ice all around it and that it was not warming the house. we have twins so we had to buy space heaters and keep them downstairs to keep warm. Finally in Feb. he sent someone to check it. without our knowledge he was coming, he was let in the house. Then, come to find out that the unit needed some things replaced. And that if was serviced yearly as it is suppose to be, this wouldn't have happened. Now, he wants the full 850 for dec. jan. and feb. Oh and the stove is burning up. it's a fire waiting to happen. Is he partially responsible at all???

On this forum it would be more appropiate if it was your landlord asking the questions here.....

You only pay $850?
Wow that must be a nice studio apt you have.
We get $850. for studio apartments in my area.

All my tenants have their own service contracts on the heating systems and the appliances. They are required in their lease to have this otherwise their butts are history.
Why don't you take care of these things? It sounds like your rent is extremely low.

It's not your fault this is happening. It sounds like you have a landlord who doesn't provide a top quality rental and also does not take measures to avoid these kinds of problems, like tenant screening, maintenance contracts, a good lease agreement, etc.

Munchkim, do you pay rent by the quarter? Dec., Jan, and Feb.? Or are you behind 3 months? Or do you pay utilities by teh quarter or are you 3 months behind on this? You post is not written clearly.

"Now, he wants the full 850 for dec. jan. and feb."

You mean the rent gas not been paid for Dec, Jan, Feb? What about March?

Why should the landlord be responsible for your utility bills if you are supposed to pay them?
Does your lease say he is responsible?

If you have electric heat then that may be fairly normal for an older place. My 1 br in college cost me 250 a month for electric in the winter and that was only 560 sq ft. My 4 unit building costs me around 800 a month to heat in the winter depending on tenant usage. Heat is expensive. Face it or move to AZ.

I hate when they don't write back after we've responded.

It's not your LL's fault there is ice and it's cold out.
Boo hoo the unit needs stuff replace. First you complain that he's not fixing stuff and now you complain that stuff needs fixed. It's a house, it requires maintenance.

I tell you what is a fire waiting to happen, it's not the stove, it's those space heaters. How many heaters do you have plugged into the same power strip that's plugged into another power strip, plugged into an extension cord that the dog has chewed up, plugged into one of those adapters that lets you plug a grounded device into an ungrounded outlet?
