To make it short, here is the bottom line. Get the "fiance" out now or all of you need to start packing. You are not staying beyond the end of the lease. You should hope that the landlord does not throw all of you out before then.

Yes as I told the other person that replied to me my fiance & I are both on the lease, as in CT all parties in the home 18 & over HAVE to be on lease-law here in CT. I was planning on looking around for a single-family house to rent maybe around late November as our lease is up Jan 1st. The apt here is nice, however, all the neighbors do is party on their porches during the work/school week til midnight or after. How the one guy (smart alec drunk) gets up & goes to work is beyond me! He always has a beer in one hand and red wine in the other! I am not breaking up with my fiance because of my landlord, nor would I be ok with him moving out & living elsewhere......we have been together & living to gether for almost 2 yrs & we are a very close couple. I love him very much, he treats me very well & treats my daughter like she was his own.

As I mentioned to the other person, my fiance was in Hurricane Katrina & in 9/11 w/Army corps of engineers and as a result developed PTSD (post-traumatic stress disorder), as well as COPD (chronic obstructive pulmonary disorder). He was found to be disabled by the State of CT, and is on disability with them, and awaiting a hearing for Social Security Disability. Being that he is considered disabled, I believe he may have rights and the landlord couldn't just throw him/us out at the drop of a hat.

    None of that matters to your situation. The fact is, your fiance is on the lease and that alone prevents your landlord from making him move out prior to the lease expiring except if he violates the lease, well he may have violated the lease when he assaulted the neighbor.

    It almost sounds like you may be looking for a way to trap your landlord into a discrimination suit. Don't go there and if your landlord was smart he wont go there with you either. Being disabled doesn't give you special rights that doesn't apply to non-disabled people. Your right in this situation is that your fiance is on the lease until it expires and therefor can not be forced to leave except if you get evicted for non-payment or lease violation.

    Remind your fiance to follow the agreement, stay out fights. Landlords don't like having to deal with their tenants like we are their parents. Don't assume that you guys can throw your weight around and violate a written agreement just because he has a disability, you are opening up a whole new can of worms there and with this kind of talk, no wonder your landlord sees you guys as problems.
