I have a tenant that as of July 22 has paid only 1/3 of July rent & is avoiding me. I get no response when I ask when I can expect the balance. The apartment is rented with all utilities (even cable & wireless internet) included. Can I legally disconnect her cable & shut off the wireless router?

That would certainly be an interesting way to get your tenant's attention. What does your lease say about the cable and internet? When your tenant calls to complain you can explain that the only way you have to pay the cable and internet is with rent money. Then follow up with a comment that you do not know how much longer you can keep the electric company from a disconnect. If there is a reconnect fee on the cable be sure to get it from the tenant. You might cut off the internet first and see what happens.

Most states disallow shut-off of necessary utilities, like water and heat. But cable and internet are not necessary and I would feel free to cut them off. Usually, if I have access to the HA/C master breaker, I just remove that and the tenant who couldn't find my phone number suddenly knows it by heart to report the malfunctioning HAC -- it's a known fact that the neighboring units sometimes mess with the breaker or a lightening strike can damage it... This gives me a chance to talk directly to the tenant about the missing rent.

No, if you are going to do that, shut of everything. It is just as illegal.

Just issue a 3-day notice and evict. You will probably get your money.

How about evicting the tenant for non-payment? That's what you are supposed to do.

You need to do some research. Here in NH there was a court case about this very subject.

I wouldn't draw attention to your cable and wireless, unless you are paying for them legally, not just siphoning off another unit.
