Ed, Please provide us with the statutes that make shutting off internet and cable as illegal. Along with that, please show us where shutting off water and electricity is legal.

I cannot say 100% that internet and cable shutoff is illegal, but if the tenant’s phone is through the internet, it could be very bad, and very illegal. (google illegal eviction)

If you agreed to provide something in the lease, you better hold up your end of the bargain if you expect to evict.

If you think shutting off electricity or water is legal, you better attend LandLording 101.

Even if shutting off water was legal, be prepared to have the tenant use your in-house as an out-house.

    If the tenant doesn't feel it neccessary to hold up her end of the lease why am I ob;igated to do so? She has only a cell phone, cable has nothing to do with it.

    Because you are a professional, and if you do not hold up your end of the contract (lease), you cannot sue (evict) for non-compliance.

    She has your place, therefore she has 'the money'. Remember, in Contracts, "he who has the money rules".

    The one that is going after the money always loses, even if they eventually win They have to put up fees to get their money.

    So, pay the utilities that you agreed to provide, and evict the tenant as soon as you can.

    If you do not, they do not owe the full amount. And a judge may award the tenant reduced rent, plus the amount that the missing utilities cost them. Treble (3x) damages is always thrown about when a poor tenant sues a rich LandLord.

The tenant only has to call the police and the State takes care of the rest.

Since an unlawful eviction is a Class A Misdemeanor, subject to criminal and civil penalties, the landlord or his representative (managing agent or super) can be subject to the following penalties: a universal summons, arrest, fines (treble damages) or an action in civil and/or criminal court.
