Landlord scammed by section 8 lady

I bought a short sale apartment, its a luxury condo. The sellers requested for me to give them an occupancy agreement until 06/30 so that they have 2+ months to find a new place. The sellers names were on the occupancy agreement. On July 1st, the sellers said they have an older lady living in the apartment under section 8 and she has been living there for the past 6years. I got scammed. No one before or at the closing told me she has been living there. So, now they are telling me to evict the lady and that they never lived there. I am going to court next week and filed a complaint with section 8 fraud investigators. Will I have a huge problem getting rid of this 80 year old scam artist? This was all planned all along. I am extremely worried and will appreciate any help from you guys.

I would be suing the sellers as well. They lied to you, committed fraud, to make a sale. A good attorney may be able to void the contract if you want.

I understand how the sellers scammed you, by saying they lived there when they didn't and by not telling you that there was a tenant. And apparently section 8 was scammed as apparently the sellers continued to collect the section 8 money for ac couple months after they didn't own the place. I don't understand how the 80 yr old tenant scammed you. But, if she's not on a lease, you should be able to evict her.

You should have requested a lease from all of the tenants before the close, and your realtor should have told you this. Send the closing paperwork to Section 8 office, request new checks. They may be able to force the previous landlord into refunding the money back to Section 8, and issue you new checks. Or call the Police. This is fraud. But having a 80 year old Section 8 lady should be a piece of cake.
