I had a tenant who deceived me several times. The most important was that on day of lease signing he changed from wanting the property for six months to wanting it month to month. I had already gone through a lot getting the place ready for them and had turned away several people for two weeks. I accepted the month to month because I didn't want to lose any more money. Three days after moving in they have more drama in their life and so they move out. He thinks I should only keep the prorated rent for the three days he was there and return the deposit and the rest of the rent to him. Does he have a right or does the lease protect me. How much do I owe him?

With a M2M agreement, he was obligated to give you a 30-day notice. Is TX a literal or term state? If literal, he owes rent up to and including 30 days after the date he gave notice or you discovered he vacated the property; if term, he owes for all of the current month, the notice is effective on the 1st of the next month and he owes for all of that month too.

Texas is a literal state (1 month's notice to terminate) so he owes you rent for the whole rental month + 2 days thereafter (since you said they left on the 3rd day).

It's also important that you should send your ex-tenant an itemized deduction for his security deposit within 30 days when he left (required by law). If you don't know his new or forwarding address, send it to his last known address (your rental unit), CERTIFIED MAIL. Not doing so, you are opening yourself up being sued for three times the amount of the security deposit claiming that they were wrongly withheld.

He owes the entire month. He may also owe the next month, as he did not give 30 days.

In any case, he is out the entire deposit.
