In there any grace period on rent due by Anonymous (Nassau county, ny) on April 1, 2011 @20:21

                              
Is there any grace period that gives the tenant to pay after the 1st of the month in Nassau county, ny

Just want to make sure there is no law that goes over what the lease says.


I have in my lpa lease and it says " in the event is not paid by the first day after due date, tenant agrees to pay a late charge of 50.00 .

So if I don't get the rent by tomorrow it's late, if I get it tomorrow it's not late?

Your question;

Answer: To my way of thinking, being a native English speaker and having a degree in English (but sometimes speaking gibberish), you are correct in your understanding.

What I put in my RA is this--you can see I have some flexibility or grace period of one day:
Rent due/Late Consequences:
Rent is due on the 1st day of each month to pay for the immediate upcoming days of the upcoming month. Rent is LATE on the third day of the month (i.e. rent is late on January 3, February 3, March 3, April 3, May 3, etc). The Owner(s)/ Landlord/ Management expects to RECEIVE the rent before the late date.
Should the rent be late for any and all reasons, including exceptional circumstances, that prevent prompt payment, Tenant will pay a late fee of $20.00 for the first 10 days of non- payment. If rent and late fee are not paid by the twelfth day of the month, this Rental Agreement will be terminated at the discretion of the Owner(s)/Landlord/Management and Tenant will vacate the premises.

Some states have a mandatory grace period. What is your hurry? Are you worried they are not paying? Do you want to evict that bad? If so, you took in a subpar renter, your fault. Are you going to go broke if you do not get it? If so, you are undercapitalized, your bad again.

Stick to 600+ credit scores, do not drag the bottom of the barrell. Only ~10% of the population has a sub-600 score.

If you are in the low income rentals, keep after them. make sure your place you are renting is a low-income place. If you are middle income place, make sure you get the right renter.

I do know in NY the tenant has 3 days to pay the rent from the date of pay or quit notice. I am not sure, but I think you can give the p/q notice the next day if rent is not paid on due date. I think late fees and dates in leases are subjective as long as they are reasonable. Personally, my agreement states that after day 5 a late fee of $10 will be charged...guess mine may be too lenient, but I haven't had any problems yet, KOW. I am in NYS and a sample lease I obtained from the city today stated "a late fee of $20 will be affixed after the 5th day of the month", with rent being due on the 1st.

Your wording seems to imply that if rent is due on the 1st, and not paid by the 2nd, it will be considered late and a fee added on the 3rd.
