I have section 8 if my apartment doesn't pass inspection and the housing authority stops payment am I still responsible for my portion of the rent??

No. It is an un-inhabitable place. That's why LLs do not like Section 8. Because of a cracked outlet cover, no rent.

In Massachusetts... you will probably be asked to leave.

The LL can withdraw from the program...by raising the rent beyond what sect 8 will pay.

What was wrong? It passed before...what changed?

Long ago (when I still have places in Massachusetts), I had a tenant that never cleaned. The place failed and inspection..and sent her a notice to move.

If it is a safety issue..the LL needs to fix it. Sect. 8 will pass the info along to the board of health or city building inspection.

Guess it depends on why it failed.

The correct answer is yes, you are still responsible for your portion of the rent, even when the rental fails inspection. I handle a number of S8 rentals and last year I bought a rental with a S8 tenant in situ. The S8 rent had been suspended due to the condition of the rental, but I was able to evict the tenant for non-payment of her portion of the rent. To stay, she would have had to pay her portion of the rent; and to leave, she would have had to provide LL with proper notice of items needing repair and then moved under LL/T law provisions. Instead, she thought she could just stay without paying. Wrong!
