If I understand you right, the toilet was merely cracked? Not shattered or broken into chunks, but the entire top comes off in one piece as a result of that crack?

If so, that doesn't sound like a tenant-caused issue. Toilet tanks are pretty darn tough, a blow strong enough to cause damage will break it at that point, smashing in one side. A crack running around the bottom sounds like a manufacturing defect. While the tenant may have done something like banging into it, I don't see how you could hit it hard enough to crack off the top of the tank without shattering it unless there was a defect to start with.

I thought that exactly but the crack is more in the middle and a big piece in the back came out as well and the toilet lid has a mark across it that matches the crack on tank. This tenant has a very large boyfriend who is there all the time and am just wondering if he was the cause and not the son as I have already served her with a violation for having him living there. I wouldn't be surprised if this crack may have been there for quite a while and she didn't report it either. This is a tenant who is always late (pays late fees every month), has had other violations and her apartment is a disaster.

    Heres a plumbing trick for when you install a new toilet to help prevent people sitting on the toilet and pushing back. Since no one ever sees the back of the tank, glue a small piece of pvc to the back of the tank. then when someone sits down and pushes against the tank it meets resistance and not an open gap, allowing the tank to crack or snap off.

    This may have been caused by the heavy boyfriend leaning back against the tank while doing his business. I've had that happen with a tenant. The tank is not meant to bear weight, but most people dont' even think about it. If the tank isn't mounted so that it is right against the wall, I usually put a wood block behind the tank so it won't shift when leaned on. I would charge the repair cost to the tenant, but why did you replace the whole toilet and not just the tank?
