I am completely baffled. Since the eviction order is good effective Jan 13 ...why do you have to go back to court next Tuesday? Is the sheriff trying to make you think it can ONLY be executed on that particular day?

I am in NY...I never use the police or the sheriff. The clerk of the court has a list of Marshals..I use one of them.

Still.. I don't understand ... if the sheriff is busy that day they tell you to go back to the court again? huh?

ask the court clerk about using a marshal.

I had the original warrant of eviction with me in court when she did the order of cause. Because the judge granted her a week to move, he crossed out Dec 23, 2011 and wrote Jan 13, 2012. The sheriff would not accept it because the judge crossed it out and re-wrote it. They did not have any copies in the court. I would have to go home an hour away just to go back with another form.
So I have to go back on Tuesday to request a new form to be filed out without cross outs.
In the meantime she gets another week of living rent free

    So the whole story is now coming out compared to your cryptic ;) posts a few days ago. It's frustrating alright but that's the way it is sometimes. You will feel full enlightenment once the sheriff locks your tenant out. Goodluck!
