Eviction/show-cause by Anonymous (NY) on January 18, 2012 @09:08

Had judgement for eviction. When Sheriff put notice on door T said never got notice. (funny he got every other one I sent him) Did a show/cause Had a lawyer that was useless. Did not show and sent someone else. Agreed to a stipulation that T would move by end of December and we would waive the rent. T did not move. Got the Warrant reissued now waiting to see if he does show/cause again. Does anyone know if I can put in for the back rent that I waived since he did not comply with the stipulation? I know I won't get it but this guy brags he has property in the Islands. It is a substantial amount of money.

First you said you had no attorney and now you say you had one who was useless and sent someone else! Your story keeps changing again and again! If your tenant had applied for a 'show cause' as you said, you would have been served with court papers which would include a copy of the affidavit which states the tenant reasons. An attorney could have prepared a response back to the court opposing the 'show cause'. You have no idea what to do and have made mistakes from day one about this tenant. In the original 'show cause' what did the tenant give as a reason?

I too have notice how the story keeps changing. This landlord has been in over her head from the start. It looks like she has been antagonizing the situation with her own actions. This should have been a routine eviction if it was handled by an Eviction Attorney way back in November. This is not the end of the story yet!
