Overdrawn checks and stealing electricity (I have pictures) Also he has stole other stuff which I can't prove. He is now late with January rent. Tomorrow I will serve a pay or quit. I think on the forms from the magistrate there is a line that states: A forfeiture has resulted by reason of a breach of conditions of the lease, to wit____________ Should I include the breach of lease on the pay or quit letter?

Overdrawn checks is a curable violation. Stick with the failure to pay rent route. Issue a 'Pay or Quit' notice as you plan to. As to stealing electricity, how is he stealing it, have the Electrical Company press charges? The tenant is innocent till a court convicts him. If your lease requires tenant to follow all laws and ordinances as to the rental, then listing that the tenant has 'endangered' the safety of the rental and others is a major breach of the lease. Either way, this tenant is one that must go.
