Our original agreement on the rent was that we would pay on the 20th with the understanding the the company we work for will sometimes slip up and pay use the next pay period which would be two weeks later. This would insure that payment was in by the 1st. Well it did happen, when I talked to to husband he remembered our agreement told me ok. My husband was working in another business they had and had a disagreement with them over that working situation. To me the matters should be seperate. I will be one week late paying my rent she wants to charge 350 as a late fee although it would be in before the first. Also though a text message she would like to change the terms of the lease agreement. What can we do and can she change a lease agreement through a text message?

The only way you can change a lease agreement is if you sign an amended lease agreement.

You should also check your current lease if the situation you were referring to is written down there somewhere. If not, then you owe rent on the 20th. Is the late fee on the lease as well?

$350 late fee for 1 week?

Sounds excessive. Usually there is a 5 day grace period (may depend on your state).

Any change to the lease should be in writing and agreed to and signed by both parties.

Did you agree to a $350 late fee in your lease? If not then you do not owe it. Sounds like they are trying to get you to move, most likely because they need someone who will pay on time. Things happen and most landlords know this and some are wiling to be flexible and some are not. Sometimes LL's can't afford to be flexible. A new lease agreement needs to be drawn up and signed by both parties. If you do not want to sign a new one then don't and just realize that when it expires they will ask you to move.

What does your lease say about due date and late fees? What does your lease say about changing terms of the lease? Do you have a lease, if so what kind? What state are you in?

Need to answer all these questions before we can really give you advice
