Okay so we have a court date next Friday for eviction of tenants in Apt. The tenants are no longer staying in the Apt. and they've allowed the electric to be shut off. The Apt. is literally right out back of our house and we haven't seen them in 5 days. The tenants on other side of duplex haven't seen or heard them either. Thing is, they haven't removed anything from the Apt. How long do they have to be gone before I can get their stuff out and clean?

How long depends on what date the judge gives them on Friday. Don't go in there if you know they still have their stuff there. Wait until (1) they get all their stuff and leave (2) they get locked out by the marshal.

If you are in court next Friday for eviction, then why are you trying to serve the tenant papers? " process server has been unable to find the tenants to serve them the court papers due to the fact that they've left and haven't come back". If you have filed for eviction and the court date is next Friday, It's best to wait till you have the rental returned by the court to you. If you enter now while the eviction is pending, you can wind up paying the tenants some money! Are you sure you understand how to do an eviction under West Virginia laws?

Wait until they are evicted, or you get keys. It's no hurry now, it's only a matter of a couple of weeks. You probably have to store their stuff anyway. If they come back, you will have to reclean.

Check your laws on how long you have to hold stuff. In MN, we hold it for 28 days.
