Well there isn't any damage to the apartment. It is in great condition and everything is maintained well. I am responsible for all the bills and rent and I make sure they are on time. So really I am asking if you were the landlord would you void the lease right when I said we have someone living there and is refusing to leave, or would you remove her and him from the situation and let the people living there stay living there because they were doing nothing wrong. I guess either way I need to do some research about the state laws.

The LL cannot evict your guest. A LL cannot evict only one T. The only thing a LL can do is evict the whole lot.

Ditto Bryan's comments -- and maybe then the LL will consider re-renting to just you and the good roomie, but you should get that on the table before you get to eviction.

Alright that would be ideal to re-rent. Now another thing is since we have clearly voided the lease. Is that grounds for the security deposit being denied?
