Alright that would be ideal to re-rent. Now another thing is since we have clearly voided the lease. Is that grounds for the security deposit being denied?

    And, no, that's not grounds for the LL to retain the SD, unless your state law specifically says so. Typically, the LL must use the SD for damages and lost rents, and then return any remainder to tenants within the state-specified time limit for doing so.

      I was unable to find in the law, but then again I am not so great at interpreting it all. But I didn't see anything about the security deposit being withheld due to someone living there not on the lease. Does anyone know for sure by chance?
