Is the tenant paying his rent directly to the condo association as ordered by the bankruptcy court? If so, he can not be evicted for not paying rent.

Tenant is paying rent due to a new statute put in place in Fl for condo associations to require the tenant to pay rent if their are outstanding fees owed. The Bankruptcy Court has not ordered anything. This is a separate issue, but the tenants attorney claims that the bankruptcy is open and the property is part of the bankruptcy estate claiming I have no rights to evict.

If the tenant is paying rent and has a lawyer to back him up, it would appear that you can not evict him. What does your lawyer say?

Don't have a lawyer for this. Unemployed with no income. You can evict for other reasons. He smoked in the unit. What I am trying to find out is if the property is listed in the bankruptcy are all my rights to evict gone. According to the bank I am still the owner until they complete the foreclosure. Hence I should have the "right" to say who lives in my property. I gave ample certified letter notice and he did not comply. He then went and told the association he was paying me money so then they ordered him to pay them to satisfy the debt. It is a bit of a mess because there are so many moving parts with associations, fees, eviction, and bankruptcy.
