Honestly, if I could afford to go without it for a little while longer, as a tenant (if I can prove I was a good tenant), I would probably just let it go for now. After 60 days I would file for treble damages against the landlord for his failure to follow the law in returning the security deposit, with full accounting, within a reasonable time. Personally, I think a reasonable time is 30 days from obtaining posession of the property.
