can we b evicted?

I have lived in a family owned home with my now young adult children for over 15 years.the home was purchase by my then father inlaw,during my divorce. He paid cash and stated that there was not ever t be a mortage. He recently passed! while his estate is in probate can we b evicited? we were instructed by him not t ever pay him any rent.

I am sorry for your father-in-law's passing.
I don't know the details, but it sounds like he bought you a house as part of the divorce settlement that his son had to go through, and permitted you to live in it free. I'm guessing the house remained in your FIL's name and your FIL paid all the insurance and property taxes on it.
You need to see an attorney but meanwhile, you should make plans to move --or pay rent IF the family permits you to stay. See an attorney about your rights while the estate is in probate. Much may depend on your state as well.

My advice is talk to a lawyer if you really want to get mixed up in the mess. Probate is complicated, and family matters get ugly quick. I don't know your situation, but if it were me, I'd be out of there and distance myself from the matter. You had a helluva a father-in-law, and I'd be willing to bet it was the kids, more than anything else, that he had in mind.

You should be more concerned with the property being sold as part of probate and the new owner wanting rent or serving you 30 days notice to vacate.

the new owner would likely require you to pay rent, and if it is still in probate i would think the executors would have to start to charge you rent
