Landlord Eviction Rights by Diane (FL) on February 6, 2012 @23:33

Does a landlord have the right to evict someone from a property that was listed in a bankruptcy that has not been discharged? If so can you direct me to the bankruptcy law code that states such.

No need, if the LL is still the legal property owner, the LL can evict.

According to my attorney in Buffalo N.Y, The LL would have to appear in bankruptcy court and request the bankruptcy be lifted for the purpose of eviction. Is the someone still paying rent during the bankruptcy?
