We are working with our landlord to renew our lease. Five of our rent payments have been late and he wants to put into the lease that if the payment is more than 5 days late then we are to be out in 45 days.

Is this legal?

Surprised your LL is even considering a renewal considering your poor payment history. As a LL I wouldn't give you the option to renew. Laws vary from state to state, so you might want to check it out, but honestly if it concerns you, then find another place to rent.

A tenant can not waive their rights to proper procedures for late rent, notices, and evictions.

You are late 4 out of 5 times and you expect to be late in the future? Your landlord expects on time payments. How unreasonable of him. You should be able to pay whenever you feel like it. Wake up and smell the coffee. Every other landlord would get rid of you now. Your landlord has reached his limit with you.

Your landlord is a moron: You can't force somebody to give up their legal rights. It is thus unenforceable.
