I was wondering if I can evict a tenant for being one month behind on rent. can I give a 5 day notice?

You can give a 5 day notice the first minute the rent is late. Serve your notice now and pick up the eviction forms at the court house. You are already 30 days late.

You can begin the process to evict when the tenant is 1 day late. You should never wait a month.
