Never allow a tenant to tell you how you are going to get paid and when. The deposit is not for rent payments. It is for leaving the place clean and for the painting, carpet replacement and repairs you have to make after they are gone. Serve your tenant a 5 day pay or quit notice now. Mail another notice by receipted certified mail immediately. On the sixth day, file for an eviction. Pick up the forms at the court house and ask for instructions if you need them. State the reason for the eviction as nonpayment of rent. You have to move now so the certified mail and the eviction certified notice can be mailed to your tenant. Otherwise, your tenant will evaporate. In this case, the mail will go to your address. Do not sign for the mail if your tenant is not home. Ask the mail carrier to leave a notice to pick up with you. Be sure to file the eviction if your tenant is not out within 5 days. It is the only way you can be sure the tenant will leave. She may get used to idea of free rent. Change your locks immediately after she is out. Not before.

It is 3 days in New York

It costs about $110 to file.
About $50. to have it served.

AND THIS WILL BE THROWN OUT as soon as the judge learns this person is not the landlord or the landlords' licensed agent.

This person has no lease by which the right to act as landlord granted.

      Well.. OP said he only had a verbal agreement.

      So.. the landlord (the only person in all this with a signed lease with a tenant) can evict.

      The OP will have to get his landlord to evict. This could be really an interesting conversation if he wasn't allowed to sublet in the first place.
