If the driveway is not included in your lease agreement and he was never given permission to park there, then you can have it towed. You may want to talk to him or post a letter first to let him know he does not nor has never had permission or the right to park in your driveway and if the car is not moved or found there again, it will be towed at his expense. I would call the local police first to cover your bases before towing. You can simply tell them at that point, you have a person parking their car in your private driveway without permission and has refused to move it.
