Her case wont delay your eviction proceedings. In fact, she is using the wrong forum at this point regarding her security deposit. A security deposit is customarily used and applied after the renter leaves if there are damages to the property beyond wear and tear. You may use it for unpaid rent. She can't force you to use it now, as she is living in the rental, for rent if you don't want to. There is only one specific time when a tenant can do that and that is when the LL hasn't put the security deposit in a separate bank account and not disclosed the location. Page 9 and 10 talk about this.
